AGREEMENT TO LEGAL TERMS
Welcome to WalkBlock, a health and productivity application designed to help you increase your daily physical activity by blocking distracting apps until you reach your daily step goal. Our goal is to provide you with tools that motivate you to walk more and reduce screen time, creating healthier habits through positive reinforcement.
IMPORTANT: WalkBlock does not collect, store, or transmit your personal data to our servers or backend systems. All data is stored locally on your device. We do not maintain user accounts or databases containing your information. The only data transmission occurs for subscription management through RevenueCat and Apple App Store, which use anonymous device-based identifiers.These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", "your") and Esnap Labs, LLC, a limited liability company registered in Ohio, United States of America ("Company", "we", "us", "our").We operate the mobile application WalkBlock ("App") and related services that refer or link to these Terms (collectively, the "Services").BY ACCESSING OR USING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND MUST DISCONTINUE USE IMMEDIATELY.These Terms constitute the entire agreement between you and the Company regarding the Services and supersede all prior agreements and understandings. Supplemental terms and conditions may be posted on the Services from time to time and are incorporated herein by reference.We reserve the right to modify these Terms at any time. 1. SERVICES OVERVIEW
1.1 Nature of Services
The App provides step tracking, app blocking, and health motivation services. Our Services include:
* Daily step tracking via Apple HealthKit integration
* App and category blocking functionality using Apple Screen Time/Family Controls
* Customizable daily step goals
* Statistics tracking including streaks, total days goal reached, and activity history
* Real-time app blocking/unblocking based on step progress
* Premium subscription features including:
- Unlimited app and category blocking (free users limited to 1 app)
- Ability to change step goals anytime (free users locked after initial setup)
- Access to all statistics and advanced features
1.2 Purpose and Intended Use
The Services are designed for:
* Increasing daily physical activity through step tracking
* Reducing screen time by blocking distracting apps
* Building healthy habits through goal-based motivation
* Tracking progress and maintaining streaks
* Personal productivity and wellness improvement
1.3 Service Limitations
* Step count data is provided by Apple HealthKit and depends on device capabilities and user activity
* App blocking functionality requires Screen Time permissions and may be subject to iOS limitations
* Step tracking accuracy depends on your device (iPhone, Apple Watch, or other HealthKit-compatible devices)
* Services are not medical, diagnostic, or therapeutic tools
* Results and statistics do not replace professional medical or fitness guidance
* App and category blocking may not work for all apps or in all circumstances due to iOS restrictions
2. ELIGIBILITY AND ACCOUNT REGISTRATION
2.1 Age Requirements
You must be at least 13 years old to use the Services. By using the Services, you represent and warrant that:
* You are at least 13 years old
* You have the legal capacity to enter into binding agreements
* All information provided is accurate and complete
2.2 No Account Required
WalkBlock does not require account creation or user authentication. The App uses device-based identification and stores all data locally on your device. You can use the Services immediately after installation without creating an account.
2.3 Device Responsibility
You are solely responsible for:
* Maintaining control and security of your device
* Managing HealthKit and Screen Time permissions
* Ensuring your device meets minimum system requirements (iOS 17.0 or later)
* Backing up any data you wish to preserve (data is stored locally and may be lost if the app is deleted)
3. ACCEPTABLE USE AND USER CONDUCT
3.1 Permitted Uses
You may use the Services only for lawful purposes and in accordance with these Terms. Permitted uses include:
* Tracking your daily step count for personal health and fitness goals
* Blocking apps to reduce screen time and increase physical activity
* Setting and adjusting daily step goals
* Viewing statistics and progress tracking
* Using premium features if you have an active subscription
3.2 User Responsibilities
You agree to use the Services responsibly and understand that:
* Step count data is provided by Apple HealthKit and depends on device capabilities
* App and category blocking requires Screen Time permissions and may not work for all apps or categories
* You are responsible for setting realistic and safe step goals
* You should consult healthcare professionals for fitness or health concerns
* You are responsible for managing your HealthKit and Screen Time permissions
3.3 Health and Safety
You acknowledge that:
* Physical activity should be appropriate for your fitness level and health condition
* You should consult a healthcare professional before starting any new exercise program
* We are not responsible for injuries or health issues related to physical activity
* Step goals should be set based on your individual capabilities and health status
4. HEALTH AND FITNESS DISCLAIMERS
4.1 Not Medical or Fitness Advice
IMPORTANT: THE SERVICES ARE NOT MEDICAL DEVICES, DIAGNOSTIC TOOLS, OR SOURCES OF MEDICAL OR FITNESS ADVICE.
The Services do not:
* Diagnose, treat, prevent, or cure any medical condition
* Provide medical, fitness, or therapeutic advice
* Replace consultation with qualified healthcare professionals
* Offer personalized medical or fitness recommendations
* Assess health conditions or fitness for physical activity
* Guarantee specific health or fitness outcomes
4.2 Step Tracking Information
* Step count data is provided by Apple HealthKit and may vary in accuracy
* Step counts depend on device capabilities, placement, and user activity
* We are not responsible for accuracy of HealthKit data
* Step tracking may not be accurate for all activities or device configurations
* Always verify step counts with your healthcare provider if used for medical purposes
4.3 Physical Activity Risks
* Physical activity, including walking, carries inherent risks
* You are responsible for ensuring activities are appropriate for your health condition
* We are not liable for injuries or health complications from physical activity
* Consult healthcare professionals before increasing physical activity levels
* Stop activity and seek medical attention if you experience pain or discomfort
4.4 Medical Consultation Recommendation
Before using the Services for health or fitness purposes:
* Consult with qualified healthcare professionals
* Obtain professional fitness guidance if needed
* Consider your individual health conditions and limitations
* Understand the risks and benefits of increased physical activity
* Set appropriate goals based on your fitness level
5. PRIVACY AND DATA PROTECTION
5.1 Privacy Policy Integration
Our Privacy Policy, incorporated herein by reference, governs the collection, use, and protection of your personal information. By using the Services, you consent to our privacy practices.
5.2 Data Collection and Use
We collect and process:
* Step count data from Apple HealthKit (read-only access)
* App and category blocking selections (stored locally on your device)
* Daily step goals and preferences (stored locally)
* Usage statistics including streaks and goal achievement (stored locally)
* Subscription status and payment information (processed through RevenueCat)
* Device-based anonymous identifiers (no personal information)
5.3 Data Storage
* All data is stored locally on your device using iOS UserDefaults
* We do not operate backend servers or databases for user data
* No data is transmitted to our servers or cloud storage
* HealthKit data remains in Apple HealthKit and is not stored by us
* Screen Time selections are stored securely on your device by iOS
* We implement security measures to protect locally stored data
5.4 Data Retention
* Local data is retained on your device until you delete the app or clear data
* Statistics are retained locally for up to 365 days, after which older data is automatically removed
* HealthKit data is subject to Apple's data retention policies
* Subscription data is managed by RevenueCat and Apple
* Deleting the app removes all locally stored data
5.5 International Data Transfers
Since all data is stored locally on your device, there are no international data transfers. Subscription data processed through RevenueCat and Apple may be processed in various jurisdictions in accordance with their respective privacy policies.
6. INTELLECTUAL PROPERTY RIGHTS
6.1 Company Intellectual Property
We own or license all intellectual property rights in the Services, including:
* Source code, algorithms, and software
* App design, user interface, and functionality
* Content, graphics, and visual elements
* Trademarks, service marks, and logos
* Step tracking and app blocking algorithms
6.2 Limited License to Users
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
* Access and use the Services for personal, non-commercial purposes
* Download and use the App on your personal devices
* Set step goals and manage app blocking preferences
* View statistics and track your progress
6.3 Restrictions on Use
You may not:
* Copy, modify, or distribute our intellectual property
* Reverse engineer or attempt to extract source code
* Use our trademarks or branding without permission
* Create derivative works based on our Services
* Use the Services for commercial purposes without authorization

7. PAYMENT TERMS AND SUBSCRIPTIONS
7.1 Pricing and Payments

* Subscription options are displayed in the App and may include:
- Monthly subscription
- Annual subscription
- Lifetime purchase (one-time payment)
* Prices are displayed in the App and may change
* All payments are processed through Apple App Store via RevenueCat
* Prices include applicable taxes unless otherwise stated
7.2 Subscription Terms
* Subscriptions automatically renew unless canceled
* Cancellation must occur at least 24 hours before renewal
* Refunds are subject to our refund policy and Apple App Store policies
* Subscription benefits are non-transferable
* Premium features are accessible only during active subscription period
* Lifetime purchases provide permanent access to premium features
7.3 Free Tier
* Free users can block 1 app
* Free users can set a step goal during onboarding but cannot change it afterward
* Free users have access to basic statistics
* Premium features require an active subscription or lifetime purchase
7.4 Payment Processing
* Payments are processed through Apple App Store and managed by RevenueCat
* We do not store payment information directly
* Billing disputes should be directed to Apple App Store support
* Subscription management is handled through your device settings
7.5 Refund Policy
* Refunds are subject to Apple App Store policies
* Subscription refunds may be available through Apple App Store
* Technical issues may qualify for refunds at our discretion
* Refund requests should be submitted through Apple App Store or by contacting us
7.6 Subscription Cancellation
* You may cancel your subscription at any time through your device settings
* Cancellation takes effect at the end of the current billing period
* You will retain access to premium features until the period ends
* No refunds for partial subscription periods
* Lifetime purchases are non-refundable except as required by law
8. THIRD-PARTY SERVICES AND CONTENT

The Services may integrate with or use third-party services, including:
* Apple HealthKit (step count data access)
* Apple Screen Time/Family Controls (app and category blocking functionality)
* RevenueCat (subscription management)

We are not responsible for:
* Third-party service availability or performance
* Third-party privacy practices or data handling
* Accuracy of data from external sources (e.g., HealthKit step counts)
* Third-party terms of service compliance
* Limitations or restrictions imposed by Apple on HealthKit or Screen Time
8.3 User Responsibility
When using third-party services through our platform:
* You must comply with their terms of service
* You are responsible for managing permissions (HealthKit, Screen Time)
* You acknowledge separate privacy policies may apply
* We disclaim liability for third-party actions or limitations
9. MOBILE APPLICATION LICENSE
9.1 License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on compatible devices you own or control.
9.2 License Restrictions
You may not:
* Decompile, reverse engineer, or disassemble the App
* Modify, adapt, or create derivative works
* Distribute, sublicense, or transfer the App
* Use the App for commercial purposes without authorization
* Remove or alter proprietary notices
9.3 App Store Terms
* Downloads through Apple App Store are subject to Apple's terms
* We are responsible for app maintenance and support
* Apple is not liable for app functionality
* Compliance with App Store policies is required
9.4 Updates and Modifications
* We may release updates to improve functionality

* No guarantee of backward compatibility
10. PROHIBITED ACTIVITIES

You agree not to:

* Attempt to gain unauthorized access to systems
* Interfere with service operation or availability
10.2 Service-Related Prohibitions
You may not:
* Attempt to circumvent app blocking restrictions
* Manipulate or falsify step count data
* Interfere with HealthKit or Screen Time functionality
* Attempt to bypass app blocking through technical means
10.3 Technical Prohibitions
You may not:
* Use automated tools to access the Services
* Attempt to reverse engineer, decompile, or disassemble the App
* Overwhelm our systems with excessive requests
* Circumvent security measures or restrictions
* Extract data for unauthorized purposes
10.4 Commercial Prohibitions
You may not:
* Use the Services for commercial purposes without authorization
* Resell or redistribute access to the Services
* Extract or scrape data to compete with our Services
11. PLATFORM MANAGEMENT
11.1 Monitoring Rights
We reserve the right, but not the obligation, to:
* Monitor app usage for technical issues
* Investigate potential violations of these Terms
* Suspend or terminate access that violates these Terms
* Cooperate with law enforcement when required

12. TERM AND TERMINATION

* Revoking HealthKit and Screen Time permissions
* Ceasing use of the Services

* Any reason with appropriate notice
12.4 Effects of Termination
Upon termination:

* App blocking functionality
* Statistics and progress tracking

* Service availability or performance
13.3 Fitness for Purpose
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
* MERCHANTABILITY
* FITNESS FOR A PARTICULAR PURPOSE
* NON-INFRINGEMENT
* TITLE OR QUIET ENJOYMENT
13.4 Technical Disclaimers
WE ARE NOT LIABLE FOR:
* Software bugs or technical errors
* Compatibility issues with devices
* Data loss or corruption
* Service interruptions or outages
* Third-party service failures (HealthKit, Screen Time)
* Limitations imposed by Apple on HealthKit or Screen Time functionality
14. LIMITATION OF LIABILITY
14.1 General Limitation
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY:
* INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
* LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
* EMOTIONAL DISTRESS OR MENTAL ANGUISH
* PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM SERVICE USE
* HEALTH COMPLICATIONS OR INJURIES FROM PHYSICAL ACTIVITY
14.2 Maximum Liability
OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE OF ACTION SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
14.3 Exclusions
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

THE LIMITATIONS IN THIS SECTION ARE ESSENTIAL ELEMENTS OF THE AGREEMENT BETWEEN US AND YOU. THE SERVICES WOULD NOT BE PROVIDED WITHOUT THESE LIMITATIONS.
15. INDEMNIFICATION
15.1 User Indemnification
You agree to defend, indemnify, and hold harmless the Company, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
* Your use of the Services
* Your violation of these Terms
* Your violation of any third-party rights
* Your negligent or wrongful conduct
* Health complications or injuries from physical activity
* Misuse of app blocking or step tracking features
15.2 Company Rights
We reserve the right to:
* Assume exclusive defense of any indemnified claim
* Control the defense and settlement of claims
* Require your cooperation in defending claims
* Seek reimbursement for defense costs

We will notify you promptly of any claims subject to indemnification and provide reasonable cooperation in the defense of such claims.
16. DISPUTE RESOLUTION
16.1 Informal Resolution
Before filing any legal action, you agree to first attempt to resolve disputes informally by contacting us at [email protected] with a detailed description of the dispute.
16.2 Binding Arbitration
Any dispute that cannot be resolved informally shall be resolved through binding arbitration conducted by the American Arbitration Association under their rules, except as modified by these Terms.
16.3 Arbitration Rules

* The arbitrator's decision shall be final and binding
* Each party shall bear their own costs unless otherwise awarded
16.4 Class Action Waiver
YOU AGREE THAT DISPUTES MUST BE BROUGHT INDIVIDUALLY AND NOT AS PART OF A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.
16.5 Exceptions
The following disputes are not subject to arbitration:
* Intellectual property disputes
* Injunctive relief requests
* Small claims court matters (under jurisdictional limits)
17. GOVERNING LAW
17.1 Applicable Law
These Terms and your use of the Services are governed by the laws of Ohio, United States, without regard to conflict of law principles.
17.2 Jurisdiction
Any legal proceedings not subject to arbitration shall be brought exclusively in the courts of Ohio, United States, and you consent to the personal jurisdiction of such courts.
17.3 International Users
If you access the Services from outside the United States, you are responsible for compliance with local laws, and you acknowledge that these Terms are governed by United States law.
18. MISCELLANEOUS
18.1 Entire Agreement
These Terms, together with our Privacy Policy and any other referenced policies, constitute the entire agreement between you and us regarding the Services.

18.3 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

We may assign our rights and obligations under these Terms to any third party. You may not assign your rights without our written consent.

We are not liable for any failure to perform our obligations due to causes beyond our reasonable control, including natural disasters, government actions, or technical failures.
18.7 Electronic Communications
You consent to receive communications electronically and agree that electronic communications satisfy any legal requirements for written communications.
18.8 Translation
If these Terms are translated into other languages, the English version shall prevail in case of any conflicts.
